BBM • SEPTEMBER - EYLÜL 2023 20 NEWS HABER According to the statement on the website of the Turkish Com- petition Authority, the investigation regarding the allegation that Nuh’un Ankara Makarnası Sanayi ve Ticaret AŞ and İs-Ra Gıda ve İhtiyaç Maddeleri Pazarlama Sanayi ve Ticaret AŞ violated Article 4 of the Law No. 4054 on the Protection of Competition with their actions to determine the resale price has been completed. As a result of the Competition Board’s investigation on August 03, 2023, it was decided that the undertakings did not violate Ar- ticle 4 of the Law on the Protection of Competition and therefore, there was no ground for imposing an administrative fine on the said undertakings. The text of the decision included the following information: “According to the Report prepared within the scope of the in- vestigation conducted pursuant to the Competition Board’s de- cision dated 07.07.2022 and numbered 22-32/518-M, the evi- dence collected, the written defenses, the statements made at the verbal defense meeting and the scope of the file examined, Nuh’un Ankara Makarnası Sanayi ve Ticaret AŞ and İs-Ra Gıda ve İhtiyaç Maddeleri Pazarlama Sanayi ve Ticaret AŞ did not vio- late Article 4 of the Law No. 4054 on the Protection of Competi- tion. Therefore, it has been unanimously decided that there is no need to impose an administrative fine on the aforementioned undertakings, and that the judicial remedy in Ankara Administra- tive Courts within 60 days from the notification of the reasoned decision is open.” Last year, the Competition Authority conducted an investiga- tion on the allegation that Nuh’un Ankara Makarnası Sanayi and its distributors violated the relevant article of the Law on the Pro- tection of Competition by their actions to determine the resale price of buyers. Good news for Nuh’un Ankara from Turkish Competition Board The investigation into Nuh’un Ankara Makarnası Sanayi ve Ticaret AŞ and İs-Ra Gıda ve İhtiyaç Maddeleri Paz- arlama Sanayi ve Ticaret AŞ has been finalized. Both companies were found not guilty by the Authority. Rekabet Kurulu’ndan Nuh’un Ankara Makarnası’nı sevindiren haber Nuh’un Ankara Makarnası Sanayi ve Ticaret AŞ ve İs-Ra Gıda ve İhtiyaç Maddeleri Pazarlama Sanayi ve Ticaret AŞ hakkında yürütülen soruşturma sonuçlandı. Kurum her iki şirketi suçsuz buldu. Rekabet Kurumu’nun internet sitesinde yer alan açıklamaya göre, Nuh’un Ankara Makarnası Sanayi ve Ticaret AŞ ve İs-Ra Gıda ve İhtiyaç Maddeleri Pazarlama Sanayi ve Ticaret AŞ’nin yeniden satış fiyatını belirlemeye yönelik eylemleriyle 4054 sayılı Rekabetin Korunması Hakkında Kanun’un 4. maddesi- ni ihlal ettikleri iddiasına yönelik olarak yürütülen soruşturma tamamlandı. Rekabet Kurulunca dosyanın 03 Ağustos 2023 tarihin- de müzakeresi sonucunda Rekabetin Korunması Hakkında Kanun’un 4. maddesini ihlal etmediklerine, dolayısıyla adı ge- çen teşebbüslere idari para cezası verilmesine gerek olmadı- ğına karar verildi. Karar metninde şu bilgilere yer verildi: “Rekabet Kurulunun 07.07.2022 tarihli, 22-32/518-M sayılı kararı uyarınca yürütü- len soruşturma kapsamında düzenlenen Rapor’a, toplanan delillere, yazılı savunmalara sözlü savunma toplantısında yapılan açıklamalara ve incelenen dosya kapsamına göre, Nuh’un Ankara Makarnası Sanayi ve Ticaret AŞ ve İs-Ra Gıda ve İhtiyaç Maddeleri Pazarlama Sanayi ve Ticaret AŞ tarafın- dan 4054 sayılı Rekabetin Korunması Hakkında Kanun’un 4. maddesinin ihlal edilmediğine, dolayısıyla adı geçen teşeb- büslere idari para cezası uygulanmasına gerek olmadığına, gerekçeli kararın tebliğinden itibaren 60 gün içinde Ankara İdare Mahkemelerinde yargı yolu açık olmak üzere oybirliği ile karar verilmiştir.” Rekabet Kurumu, geçen yıl Nuh’un Ankara Makarnası Sanayi’nin ve distribütörlerinin, alıcıların yeniden satış fiyatını belirlemeye yönelik eylemleriyle Rekabetin Korunması Hak- kında Kanun’un ilgili maddesini ihlal ettikleri iddiası üzerine soruşturma yürütmüştü.
